California Senate Bill 909
The Concerned CRAs-affiliated firms listed below support in principal the aims and objectives of California Senate Bill 909, introduced on January 27, 2010.
This bill would require employers who use consumer reporting agencies (CRA’s), commonly called background screening firms, that offshore consumer information to disclose and get authorization from the consumer to offshore their data.
CRAs would have to disclose to what countries their info is being off-shored, truncate SSNs, have a privacy policy related to off-shored data, and be liable for consumer harm that occurs from off-shored data.
These requirements would not apply to international research like non-US criminal or education verifications, however. Also, an amendment is anticipated that would exclude transactions that simply retrieve information that may already be stored offshore, such as consumer credit report information.
